Terms & Conditions
WooHoo Trading Limited Terms
1. Introduction
By placing an order to rent a bike, scooter, or vehicle from WooHoo Trading Limited (“WooHoo”, “the Company”), you (“the Hirer”) agree to these Terms and Conditions.
They are designed to ensure safety, fairness, and care for both you and our equipment. Please read carefully before signing or confirming your booking.
2. Eligibility and Licensing
- The Hirer must be at least 18 years old and hold a valid driver’s licence suitable for the vehicle hired.
- Electric Bikes: minimum age 16; helmets are mandatory.
- 50cc Scooters: any valid driver licence is acceptable.
- 110cc Scooters or larger: a restricted or full motorcycle licence is required.
- Cars or other vehicles: full car licence required.
- WooHoo staff may request proof of licence and identification before releasing any vehicle.
- A short confidence or safety test may be required before hire begins.
3. Safety and Conduct
- Helmets must be worn at all times.
- Follow all New Zealand road rules and local regulations.
- Ride or drive only on paved, public roads—no beaches, gravel tracks, or off-road areas.
- Never operate any vehicle under the influence of alcohol, drugs, or substances that may impair ability.
- Carry no more passengers than the vehicle is designed for.
- Check brakes, tyres, and lights before departure; report any concerns immediately.
4. Vehicle Condition and Inspection
- The Hirer must inspect the vehicle before leaving the premises and note any existing damage with WooHoo staff.
- Vehicles must be returned in the same condition as received, allowing for ordinary wear and tear.
- If returned dirty, sandy, or with saltwater exposure, a minimum cleaning fee of NZ $25 may apply.
- Any unauthorised modification or repair is prohibited.
5. Insurance and Liability
- Standard insurance applies with an excess between NZ $350 and NZ $3,000 depending on the extent of damage.
- If the vehicle is used recklessly or contrary to these Terms, the excess increases to NZ $3,000.
- Optional Reduced Excess Cover may be purchased for NZ $20 per hire, lowering the excess to NZ $385.
- Hirers under 21 years are not eligible for insurance cover.
- The Hirer is liable for all loss or damage resulting from breach of these Terms, including towing, recovery, and loss-of-use costs.
6. Prohibited Uses
The Hirer must not:
- Use the vehicle for racing, stunts, couriering, or commercial hire.
- Sublet, lend, or transfer possession to another person.
- Operate the vehicle while unlicensed, disqualified, or impaired.
- Tamper with the speedometer, odometer, or safety systems.
- Take the vehicle outside New Zealand without written consent.
7. Payment, Deposits, and Security
- All rental fees must be paid in full before the vehicle is released.
- A valid credit or debit card must be provided and will be securely held on file during the rental period as a guarantee.
- WooHoo may charge the card for verified damages, late fees, loss, or breach of contract.
- If a security deposit is taken, it will be refunded once the vehicle is returned in satisfactory condition.
8. Loss, Theft, or Extended Possession
- If a vehicle is not returned within 24 hours of the agreed end time, it is considered lost or stolen. The Hirer’s card may be charged NZ $2,350, and a police report may be filed.
- Any disappearance or theft must be reported to WooHoo within 24 hours and to the NZ Police within 48 hours.
- The Hirer remains liable for all loss until an official report is filed.
9. Refund and Cancellation Policy
- More than 7 days before hire: full refund.
- 3 to 7 days before hire: 50 % refund.
- Within 48 hours: no refund.
- No refunds apply once the hire period has commenced or for early returns.
- Refunds are processed to the original payment method.
10. Return of Vehicle
- The vehicle must be returned to the agreed location by the scheduled time.
- Late returns incur a 10 % late fee plus any additional daily hire cost.
- Early termination by the Hirer may result in a two-day minimum charge and recalculated costs.
- If the Hirer fails to comply with these Terms, WooHoo may demand immediate return without refund.
11. Accidents and Repairs
In case of accident, breakdown, or damage:
- Stop and ensure safety first.
- Notify WooHoo immediately with full details.
- Do not authorise repairs without WooHoo’s consent, except to prevent further damage.
WooHoo may take up to 48 hours to repair or replace the vehicle.
12. Indemnity
The Hirer indemnifies WooHoo Trading Limited, its employees, and agents against any claims, losses, or expenses arising from:
- Personal injury, death, or property damage caused by the Hirer’s act or omission; or
- Breach of these Terms by the Hirer.
This indemnity binds the Hirer’s executors, administrators, and personal representatives.
Nothing in this clause limits your rights under the Consumer Guarantees Act 1993 or any other law that cannot be excluded.
13. Consumer Guarantees
Where the hire is for personal, domestic, or household use, your rights under the Consumer Guarantees Act 1993 apply and cannot be excluded.
If the hire is for business purposes (as defined by the Act), the Act does not apply, and WooHoo Trading Ltd’s liability is limited to the terms stated in this agreement.
14. Privacy
WooHoo Trading Limited collects and holds personal information to manage bookings, contact customers, and recover property or charges. Information is handled in accordance with the New Zealand Privacy Act 2020.
You may request access to or correction of your personal information at any time.
15. Dispute Resolution
If any disagreement arises, both parties agree to first attempt to resolve the matter in good faith through direct discussion or mediation before taking formal legal action.
16. Governing Law
These Terms are governed by the laws of New Zealand. Any dispute shall be dealt with by the courts of New Zealand.
17. Acceptance of Terms
By signing below or confirming online, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
18. Reviews and Public Feedback
WooHoo Trading Limited welcomes honest feedback.
By posting or submitting a review, you confirm it reflects your genuine experience as a customer.
If we believe a review is false, misleading, offensive, or not based on a real hire, we reserve the right to request its removal from the relevant platform.
The Company may reproduce reviews, in full or in part, for marketing or promotional purposes (without altering the meaning).
This clause does not limit your rights to share genuine opinions or experiences under the Fair Trading Act 1986 and Consumer Guarantees Act 1993.
